1. Agreement to Terms

By accessing or using Clawd Colony (“the Service”), operated by Clawd Colony (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Clawd Colony is an AI bot platform that allows users to create, customize, and deploy AI-powered assistants on messaging platforms including Telegram, Discord, and Slack. The Service includes bot creation, app integrations via OAuth, and subscription-based billing.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Send spam, phishing messages, or unsolicited communications
  • Harass, abuse, or harm other individuals
  • Distribute malware or engage in any malicious activity
  • Attempt to gain unauthorized access to other users' accounts or data
  • Generate content that is illegal, harmful, or violates third-party rights
  • Circumvent any usage limits, rate limits, or billing controls

We reserve the right to suspend or terminate accounts that violate these terms.

5. Billing and Subscriptions

Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

  • Free Trial: New subscriptions include a 7-day free trial. You will not be charged during the trial period. You may cancel at any time during the trial without being charged.
  • Introductory Pricing: Some plans offer introductory pricing for the first 3 months of paid billing. After the introductory period, the regular price applies automatically.
  • Cancellation: You may cancel your subscription at any time through the billing portal. Your service continues until the end of the current billing period. No partial refunds are issued for unused portions of a billing period.
  • 30-Day Money-Back Guarantee: If you are unsatisfied with the Service within the first 30 days of your first paid billing cycle, contact us for a full refund.
  • Failed Payments: If a payment fails, your account will be placed in a past-due state. We will attempt to collect payment for up to 14 days before suspending service.

6. Data and Content

You retain ownership of all content you create through the Service, including bot configurations, integrations, and custom personalities. We do not claim ownership of your data. We store and process your data solely to provide and improve the Service. See our Privacy Policy for details on data handling.

7. Third-Party Integrations

The Service integrates with third-party platforms (Google, Slack, Telegram, Discord, Notion, GitHub, etc.) via OAuth. We do not store your passwords for these services. Your use of third-party services is subject to their respective terms of service and privacy policies.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify users of planned downtime. Enterprise plans include SLA guarantees as specified in separate agreements.

9. Limitation of Liability

The Service is provided “as is” without warranties of any kind, either express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

10. Account Termination

You may close your account at any time. Upon cancellation, there is a 14-day grace period during which your data is preserved and you may reactivate. After the grace period, your data will be permanently deleted. We reserve the right to terminate accounts that violate these terms, with or without notice.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to conflict of law principles.
